By accessing, registering for, subscribing to, or otherwise using GetFIT App (www.joingetfitapp.com), you expressly acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service, Disclaimers, Privacy Policy, Cookie Policy, and any other policies incorporated by reference on this page. Your continued access to or use of the platform constitutes your acceptance of these documents. If you do not agree, you must not register for, subscribe to, access, or use GetFIT App or any of its services.

1. Who Can Use GetFIT App

• GetFIT App is a web platform. To use any part of it, you must create an account.
• You must be at least 18 years old. By registering, you confirm and declare that you are 18 or older. We do not knowingly provide services to anyone under 18, and we reserve the right to terminate any account found to violate this rule.
• You are responsible for keeping your login credentials confidential and for all activity that happens under your account.
• We reserve the right to suspend, restrict, or permanently terminate any account, without notice, if we reasonably believe you have violated these Terms, abused the platform, engaged in fraudulent activity, attempted to circumvent billing or free trial restrictions, or used GetFIT App in a manner that could harm the platform or other users.

2. Acceptable Use

You agree not to:

• Share or sell your account credentials.
• Attempt to gain unauthorized access to GetFIT App or its systems.
• Reverse engineer, copy, scrape, or exploit any part of the platform except as permitted by law.
• Upload malicious software, spam, or content that interferes with the operation of the platform.
• Use GetFIT App for any unlawful purpose or in violation of applicable laws.

3. Intellectual Property

• All logos, brand assets, graphics, written content, videos, and materials on GetFIT App and its social media profiles are the intellectual property of GetFIT App, unless otherwise noted.
• You may not copy, reproduce, redistribute, or repost our logos, branding, or content — in whole or in part, electronic or otherwise — without our prior written, signed consent.
• Some images and graphics used throughout the platform are intended for illustrative purposes only.
• GetFIT App is an independent business and is not affiliated with, endorsed by, or partnered with Facebook, Instagram, YouTube, or any other third-party platform or brand. Any references to these platforms (e.g., for video playback or login) are purely functional. All third-party trademarks remain the property of their respective owners.
• Any third-party trademarks, logos, brand names, or product names displayed or referenced on our site remain the property of their respective owners. Their use is solely for identification, compatibility, informational, or illustrative purposes and does not imply any affiliation, sponsorship, endorsement, or ownership by GetFIT App unless expressly stated.

4. Health Disclaimer — Not Medical Advice

• All content on GetFIT App (workouts, recipes, nutritional guidance, coaching materials, etc.) is provided for general educational and informational purposes only.
• We are not physicians, dietitians, or licensed medical professionals, and nothing on this platform constitutes medical advice.
• Our content reflects our own experience and interpretation of publicly available research, and is intended for healthy adults only.
• Consult your doctor before starting any exercise program, diet, or supplement routine — especially if you have a pre-existing condition, injury, or health concern.
• Nutritional information (calories, macros, etc.) is provided in good faith and is generally accurate but may not be exact in every case.
• You use all content, programs, and recommendations at your own risk. GetFIT App accepts no liability for injury, illness, or damages resulting from your use of this information.

5. No Guaranteed Results

• GetFIT App provides tools, education, and resources — it does not and cannot guarantee any specific outcome, weight change, or fitness result.
• Your results depend entirely on your own effort, consistency, adherence to programs, and individual circumstances (genetics, health conditions, lifestyle, etc.).
• We are not responsible for a lack of progress, and no guarantee of results — express or implied — is made by using our platform, free or paid.

6. Subscriptions & Billing

• GetFIT App offers multiple subscription plans (e.g., monthly and annual), described at the time of purchase.
• All subscriptions are processed securely through Stripe at checkout.stripe.com. The price and renewal frequency for your selected plan are clearly displayed before you confirm your purchase.
• All plans automatically renew at the end of each billing period unless cancelled beforehand.
• Cancellation: You can cancel anytime from your Account Settings page. Once cancelled, you will not be billed for the next renewal, and your access continues until the end of your current paid period.
• All sales are final. We do not offer refunds, in full or in part, for any subscription payment, including partial billing periods, unused time, or dissatisfaction with results.
• Upon subscribing, you get instant access to our digital content — including recipes, ebooks, workout plans, and other materials — directly within the web app.
• If you believe you were billed in error, contact our support team; billing disputes will be reviewed on a case-by-case basis, but this does not guarantee a refund.

7. Free Trials

• Free trials, where offered, are managed through Stripe and last for a set number of days from activation (as shown at signup) before your first payment is charged.
• You can cancel your trial anytime from Account Settings before it ends to avoid being charged.
• If a trial expires without cancellation, the first payment will be processed and is non-refundable.
• Creating a new account to repeatedly claim free trials, or cancelling and re-registering to avoid billing, is prohibited and may result in a permanent ban from GetFIT App.

8. EU Consumers — Digital Content & Right of Withdrawal

• If you are a consumer located in the European Union (or another jurisdiction granting an equivalent right), you may ordinarily be entitled to a 14-day right of withdrawal on new purchases.
• This right does not apply to digital content not supplied on a tangible medium once its performance has begun, provided you have given prior consent to immediate delivery and acknowledged the resulting loss of your withdrawal right.
• By subscribing to GetFIT App, you expressly request immediate access to our digital content (including recipes, workout plans, ebooks, and other platform materials) starting at the moment of purchase, and you acknowledge and agree that:
  • You consent to immediate performance of the service before the 14-day withdrawal period would otherwise end; and
  • You thereby lose your right of withdrawal once access to the digital content has been provided.
• This does not affect your ability to cancel your subscription at any time to prevent future renewals (see Section 6), but amounts already paid for digital content already delivered remain non-refundable as set out in these Terms.

9. Account Deletion

• You may request deletion of your account and personal data at any time by contacting us through our Support Hub.
• If you have an active paid subscription and request account deletion, your subscription will be cancelled and will not renew, but you will not receive a refund for any remaining time on your current billing period.
• Once your account is deleted, your data will be permanently removed in accordance with our Privacy Policy below, and this action cannot be undone.

10. Service Availability

We strive to keep GetFIT App available at all times, but we do not guarantee uninterrupted or error-free operation. Maintenance, software updates, technical issues, third-party service interruptions, or events beyond our reasonable control may temporarily affect access to the platform.

11. Account Suspension & Termination

We reserve the right to suspend, restrict, or permanently terminate your account, with or without notice, if we reasonably believe you have violated these Terms, abused the platform, attempted to circumvent billing or free trial restrictions, engaged in fraudulent or unlawful activity, or otherwise used GetFIT App in a manner that could harm the platform or other users.

12. Third-Party Services

GetFIT App may rely on third-party providers, including Stripe for payment processing and other service providers that help operate the platform. We are not responsible for the availability, security, or performance of third-party services.

13. Limitation of Liability

• To the maximum extent permitted by law, GetFIT App (including its owners, employees, and contractors) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform — including but not limited to injury, loss of data, loss of profits, or loss of results.
• Our total liability for any claim relating to your use of GetFIT App is limited to the amount you paid us in the twelve (12) months preceding the claim.
• The platform and its content are provided "as is" and "as available" without warranties of any kind, express or implied.

14. Force Majeure

We are not responsible for delays, interruptions, or failures caused by events beyond our reasonable control, including natural disasters, internet outages, cyberattacks, governmental actions, labor disputes, or failures of third-party service providers.

15. Indemnification

By using GetFIT App, you agree to indemnify and hold harmless GetFIT App, its owners, and staff from any claims, damages, losses, or expenses (including legal fees) arising from your misuse of the platform, violation of these Terms, or violation of any law or third-party right.

• You can unsubscribe anytime from this type of newsletter content via the link at the bottom of any email — this is immediate and does not affect your account.
• Even after unsubscribing from marketing, we will still send essential account-related messages (e.g., password resets, support replies), as these are not considered marketing.

17. Amendments to These Terms

We reserve the right to modify, update, or supplement these Terms and Conditions at any time, at our sole discretion and without prior notice. The most current version will always be available on this page.

• Any changes become effective immediately upon posting.
• It is your responsibility to review this page periodically. Continued use of GetFIT App after changes are posted constitutes your acceptance of the updated Terms.
• If you no longer agree with these Terms, you may request deletion of your account and personal data via our Support Page.
• If you do not agree with these Terms, please do not register, subscribe to, or use GetFIT App, and discontinue use of the website.

18. Governing Law

This Agreement is governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. If you are a consumer residing in the European Union, you retain all mandatory consumer protection rights available under the laws of your country of residence, notwithstanding this governing law clause.

19. Third-Party Data & AI Feature Disclaimer

Nutrition Data Sources

‍Our calorie tracker and macro search features draw on publicly available food databases, including USDA FoodData Central (a U.S. government public-domain database, fdc.nal.usda.gov) and Open Food Facts (an open database licensed under the Open Database License, world.openfoodfacts.org). By using these features, you acknowledge this data comes from third-party sources and is subject to their respective licensing terms. We work to keep this information accurate but cannot guarantee its completeness or correctness, and any data you extract or share further must comply with the original licensing terms of these databases.

AI-Powered Features

‍Certain features (such as food/meal analysis) may be powered by third-party artificial intelligence technology. These tools are meant to assist you but may occasionally produce inaccurate, incomplete, or unsuitable output. Do not share sensitive personal information through these features, and use any AI-generated suggestions at your own discretion. GetFIT App does not accept liability for inaccuracies, errors, or issues arising from the use of AI-assisted features, and such output should not be treated as professional advice.
